WHAT IS FAMILY LAW MEDIATION?

Mediation is a process where the parties meet with a trained mediator who acts in a neutral role to facilitate discussion and assist them to a consensual agreement.  Mediation can take place at any stage of separation or even before separation in the case of parties who wish to enter into a marriage (pre-nuptial) or cohabitation agreement.  Mediation can be initiated by either or both parties at any stage of litigation and it can also take place after an agreement or court order in is in place if the circumstances of the family change and they need to reach new agreements.  Other mediation professionals, such as counsellors, child specialists and financial professionals may also be engaged to “co-mediate” to assist the family to the best possible resolution.
